Alberta Government Fixes Bill 19

Credit where credit is due.The government has proposed amendments to Bill 19, the Land Assembly Project Area Act.Some of the problems with the old act were that it provided no guarantee of compensation to landowners for restrictions placed on their land, it provided no limit on how long those restrictions could last, and it seemed to exclude the act from the requirements of the expropriation act.The government maintains that this third problem was an appearance only.  That said, their proposed amendment is to remove the offending section entirely, and replace it with nothing.  It would be an interesting question to ask the Infrastructure Minister what purpose that clause was supposed to serve other than excluding the application of the expropriation act (or common law rules of expropriation), and why that purpose is being sacrificed entirely in the name of mere clarity.With regard to the lack of compensation and the lack of limits, there is now a two-year limit, and - more importantly - the landowner can force the government to purchase their land from them at fair market value any time after it's been designated.As far as I'm concerned, that eliminates the problems that existed with Bill 19.  I think the act is reasonable with the proposed amendments.  Ed Stelmach's conservatives deserve criticism for having presented this Bill in its original form, and little credit for having made the obviously necessary amendments.That said, there is no value in continuing to oppose it on the sole grounds that there has been inadequate public consultation.
